Terms of Service and Player Disclaimer

The short version

Ultimate Dominion is free to play, and you never need to spend money to enjoy it. By creating an account you agree to these terms.

• Free, always. Ads and offers are optional. Skipping them never blocks your progress.
• Play fair. No bots, cheats, scripts, multiple accounts or exploits. Breaking this can mean losing your account, your bank and any UDcoins not yet cashed out.
• Earnings are optional, 18+, and a gift, not a guarantee. Players 18 and over who verify their identity can earn UDcoins from optional videos and offers. 1 UDcoin = $1.00.
• Nothing hidden. Earnings show as Pending until our ad partners pay us, then Available. You can cash out from $20 as a gift card or PayPal.
• Taxes. If your cash-outs pass the IRS reporting limit in a year, we need your tax form and we report the amount to the IRS.
• Look after yourself. Take breaks. If you have epilepsy or a condition we can help with, tell us and we’ll try to accommodate you.

Terms of Service

These terms are an agreement between you and MrkByDesign (“we”, “us”), which runs Ultimate Dominion: The Awakening at udawake.com (“the game”).

1. Accepting these terms

By creating an account or playing, you agree to these terms. If you do not agree, do not use the game.

Clicking “I agree”, creating an account or continuing to play counts as your electronic signature under the Connecticut Uniform Electronic Transactions Act and federal law. We keep a record of which version of these terms you agreed to and when.

2. Who can play

1. You must be at least 13 years old to play.
2. You must be 18 or older and verified to earn UDcoins, cash out, or win cash prizes (see section 9).
3. You must not play from a place where the game or its reward features are prohibited.

3. Your account

1. One account per person. One hero per account, unless we give you more for testing.
2. Keep your password private. You are responsible for what happens on your account.
3. Your account, heroes, items and in-game currencies belong to the game; you have a licence to use them while you play.
4. You may ask us to close your account at any time.

4. Free to play

The game is free. No purchase, ad or offer is ever required to play or progress. Optional purchases and optional ads give conveniences or cosmetics, never an unfair advantage over players who don’t use them.

5. Fair play and conduct

You agree not to:

• use bots, scripts, macros, automation, modified clients or browser tools to play or to change the game;
• exploit bugs (report them instead; we may reward helpful reports);
• run multiple accounts, share accounts, or use VPNs or other tricks to farm rewards;
• harass, threaten, impersonate or spam other players, or post hateful, sexual or illegal content in chat, mail or boards;
• buy, sell or trade accounts, items or in-game currency for real money outside the game.

6. Enforcement

If you break these terms or any in-game rule, we may warn, mute, suspend or ban you, and remove items or currency gained unfairly. We will tell you why when we can.

If your account is banned, you forfeit your in-game bank and any UDcoins you have not yet cashed out, whether Pending or Available. Cash-outs already completed are not affected.

You can appeal any ban by writing to info@mrkbydesign.com. We will review every appeal, but the final decision is ours, at our sole discretion, and we are not required to explain or change it.

Protective holds. While we look into suspected cheating, fraud or a security problem, we may temporarily freeze your account, UDcoins or cash-outs. A hold is not a final decision that you did anything wrong, and we lift it when the review is finished.

To detect cheating we may use activity logs, device and network information, transaction history, gameplay patterns and reports from other players. We do not have to reveal how we detect it.

7. Ads and offers

1. Ads are always optional. You choose to watch a video, and we show the reward before you start. Ads never play during Outworld exploring or combat.
2. The Tavern offerwall lists offers from outside companies (for example surveys, sign-ups or apps). Those companies, not us, decide whether an offer is completed and pay us for it. Their own terms and privacy policies apply to what you do with them.
3. There is no daily limit on how many reward videos you can watch. We record each ad you watch (which partner, when, and the reward) so we can credit you correctly and spread views fairly across our ad partners in line with their rules. If one partner has no more ads for you, another partner’s ad may be shown instead, or no ad may be available for a while.

8. UDcoins

1. UDcoins are reward credits. 1 UDcoin = $1.00. You can hold fractions (for example 0.0125 UD from one video).
2. UDcoins are not a cryptocurrency, investment or bank deposit, and they do not earn interest.
3. You earn UDcoins only from optional reward videos and offers. They can never be won in chance games (the Gambler, Dragon Tears, Grimspin, barrels) and cannot be traded between players.
4. Gold, gems and items can never be turned into UDcoins or cash.
5. You can spend Available UDcoins on specific upgrades or cosmetics, or sell them back to us for cash (section 10).

9. How earnings are shared

1. Money we receive from ad and offer partners, after the partners’ own fees, is split: 50% to the game, 25% to the player who earned it, and 25% given back to the players through game events, raffles, awards, giveaways and other parts of the game that return it to the community (the “community pool”).
2. Your 25% is credited to you as UDcoins. It shows as Pending until our partner actually pays us (usually 30–60 days), then becomes Available. If a partner reverses or refuses to pay for a view or offer (for example because of fraud), the matching Pending credit is removed.
3. Your Earnings page lists every credit with its date, source, amount and status.
4. To earn, cash out or win cash prizes you must be 18 or older and complete identity verification through our verification partner. One verified person, one earning account.

Earnings are a gift, not a guarantee. UDcoins and prizes are an optional thank-you we share with players when our partners pay us. They are not wages, a salary, or promised income, and you should not rely on them. How much you can earn depends on the ads and offers our partners make available, and it may go up, go down, or stop at any time.

10. Cashing out

1. Verified players can sell Available UDcoins back to us at $1.00 each, from a minimum of $20.
2. Payouts are made by gift card (Visa or selected stores) or PayPal. The cash-out screen shows the exact amount before you confirm.
3. We may hold a cash-out for review if we see signs of fraud, multiple accounts or automation.

11. Taxes

1. Money you receive from the game may be taxable income for you. You are responsible for your own taxes.
2. We keep a yearly total of each player’s cash-outs and prizes. If your total passes the IRS reporting threshold in a calendar year, we must report it to the IRS (Form 1099).
3. Before you cash out past that threshold, we will ask for your tax form (Form W-9 in the US; Form W-8BEN outside the US). Until it is received, cash-outs pause at the threshold. Your earnings are kept, not lost.
4. State rules may also apply. Tax forms are stored securely and seen only by the owner and our accountant.

12. Prize pools, tournaments and raffles

1. The community pool (25% of partner income) is given back to the players through game events, raffles, awards, giveaways and other community rewards. We publish how each period’s pool is divided.
2. Only verified players 18+ can win cash prizes. Cash prizes count toward your yearly tax total.
3. Raffles are always free to enter, with official rules published for each one. No purchase is necessary.

13. Purchases

1. You can buy cosmetic items (for example auras, name colours, frames and pet skins) with real money or UDcoins. They change how things look, not how strong you are.
2. Payments are processed by our payment partners (such as Stripe or PayPal). Purchases are final once delivered, except where the law requires a refund or an item was not delivered.

14. Other companies

The game uses outside services for ads, offers, identity checks, payments and gift cards. We are not responsible for their services, websites or decisions, but we will help you contact them if something goes wrong.

15. Our content and your content

The game, its name, story, artwork, music and code belong to MrkByDesign and its licensors. We give you a personal, limited, revocable, non-transferable licence to play for your own non-commercial enjoyment. You may not copy, sell, reverse-engineer, scrape or reuse the game or its content without permission. Screenshots and videos of your own play for non-commercial sharing are welcome.

Anything you post (names, chat, mail, board posts, reports or appeals) stays yours, but you let us store, display, transmit and moderate it as needed to run and protect the game. We may remove anything that breaks these terms.

16. No guarantees

We work hard to keep the game running and fair, but it is provided “as is”. We don’t promise it will always be available, error-free, or that any feature, reward rate or item will stay the same. Game balance, prices and reward rates may change; the rules for earnings in effect when a credit is earned apply to that credit.

17. Limits on our responsibility

To the extent the law allows, MrkByDesign is not liable for indirect or consequential losses, lost data, or lost game progress. Our total liability to you is limited to the greater of $100 or the amount you paid us in the 12 months before the claim, plus any Available UDcoins you were owed.

18. Your privacy

1. We collect what we need to run the game: your account details, gameplay records, chat and messages, device and network information, verification status and transactions.
2. We use reasonable safeguards to protect it, but no online system is perfectly secure.
3. Some of it is handled by our service providers (hosting, identity checks, payments and ad partners) under their own privacy terms.
4. If the Connecticut Data Privacy Act applies to you, you can ask us to confirm what personal data we hold, give you a copy, correct it, delete it, or stop using it for targeted advertising, sale or profiling. Write to info@mrkbydesign.com. If we refuse, you can appeal; if the appeal is refused, we will tell you how to contact the Connecticut Attorney General.

19. Your responsibility to us

If someone makes a claim against us because you broke the law or these terms, cheated, misused someone’s identity or infringed someone’s rights, you agree to cover our resulting costs, including reasonable legal fees, to the extent the law allows.

20. Events outside our control

We are not responsible for delays or outages caused by things beyond our reasonable control, such as natural disasters, power or internet failures, cyberattacks, hosting or payment-network outages, government action or changes in law. We will do what we reasonably can to get things running again.

21. Resolving disputes

1. Before going to court, write to info@mrkbydesign.com describing the problem and what you want. We will both try in good faith to settle it for at least 30 days.
2. If that doesn’t work, we can both agree to mediation, online or in Connecticut.
3. There is no forced arbitration. Arbitration happens only if we both agree to it in writing after a dispute starts, and you can always use small claims court.
4. Either side can ask a court for urgent relief to stop hacking, misuse of the game’s content, or other immediate harm.
5. Nothing here takes away your rights under the Connecticut Unfair Trade Practices Act or other consumer laws that cannot be waived.

22. Changes to these terms

We may update these terms. We will post the new version with its date and tell players in the game before important changes take effect. Continuing to play after that means you accept them.

23. Ending your account

You can stop playing and close your account at any time. When a verified account closes in good standing, Available UDcoins above the $20 minimum can still be cashed out. We may close accounts that break these terms or in-game rules; a banned account forfeits its bank and any UDcoins not yet cashed out (section 6).

24. General terms

• These terms, together with any rules we publish for a specific feature (for example raffle rules), are the whole agreement between you and us.
• Playing the game or earning UDcoins does not make you our employee, partner or agent.
• You can’t transfer your account or these terms to anyone else. We may transfer them if the game is sold or reorganised.
• If one part of these terms can’t be enforced, the rest still applies.
• If we don’t enforce a rule once, we can still enforce it later.
• If we offer a translation, the English version controls.

25. Governing law and contact

These terms are governed by the laws of Connecticut, United States. Court cases go to the state or federal courts in Connecticut, unless your local consumer law gives you the right to another court. Questions, appeals, accommodation requests and tax forms: info@mrkbydesign.com.

Health and wellbeing

Please play in a way that is good for you. Ultimate Dominion is a game, and your health, sleep, work, school, money and relationships come first.

Play responsibly

• Take a break of at least 10–15 minutes every hour.
• Stop if you feel tired, sore, dizzy or stressed.
• The optional earnings are a small bonus, not a job or a reliable income. Never skip sleep, work or responsibilities to earn them.

If gaming feels out of control

If you find it hard to stop playing, or gaming is causing problems in your life, you are not alone and help is available:

• SAMHSA National Helpline (US): 1-800-662-4357, free and confidential, 24 hours a day, 365 days a year.
• 988 Suicide & Crisis Lifeline (US): call or text 988 if you are in crisis or thinking about harming yourself.
• Outside the US, please contact your local health service or emergency number.

Photosensitive seizure warning

A very small number of people may have a seizure when exposed to certain lights, flashing, or patterns, including in video games. This can happen even to people with no history of seizures or epilepsy. The game includes glowing, flashing and moving effects (for example spells, portals, the Medallion spin and fishing effects).

Stop playing immediately and see a doctor if you experience dizziness, altered vision, eye or face twitching, jerking or shaking of the arms or legs, confusion, or loss of awareness. If you or anyone in your family has epilepsy or has had seizures, please speak with a doctor before playing.

Tell us if you have epilepsy or a similar condition. We can set up a personal play-time limit that pauses the game for you after a set time, and we can try to reduce flashing effects on your account.

Our responsibility

We design the game to be fair and safe, but we cannot know each player’s health. To the extent the law allows, MrkByDesign is not responsible for health problems, injuries, or dependencies that may be caused or made worse by playing, including from long play sessions. This does not limit any rights you have that cannot be limited by law.

Accessibility and accommodations

We want everyone who can play safely to be able to enjoy the game. If you have a disability, health condition or other concern, write to info@mrkbydesign.com and tell us what would help. We keep what you tell us private and use it only to help you.

Examples of what we can try to set up:

• a personal play-time limit or break reminders that pause the game after a set time;
• fewer flashing or fast-moving effects on your account;
• more time for timed activities (for example fishing bites or Arrick Fields);
• turn-by-turn combat instead of auto-attack, so nothing moves faster than you choose;
• help with reading text, colours or controls.

We will tell you honestly what we can and cannot change. If we believe a part of the game could be unsafe for you (for example flashing effects with photosensitive epilepsy), we may recommend that you avoid that part, or avoid playing, and suggest you check with your doctor. Any accommodation is offered to help you, not as medical advice.
